Midnight Markdown is an independent game made and run by an individual under the name grailsformail.
We respect copyright and expect users to do the same. This page explains how we handle notices under the U.S. Digital Millennium Copyright Act (17 U.S.C. 512). It describes our process and is not legal advice; if you are unsure whether something infringes, consider asking a lawyer before you send a notice.
1. What this covers
Anything on this site or in the Midnight Markdown game, including what users put in: usernames, player and lobby names, and runs and names posted to the online board.
2. Designated agent
Send notices and counter-notices to our designated agent: [designated DMCA agent name, postal address, phone and email, to be added by the operator after registering an agent with the U.S. Copyright Office]
Until an agent is listed, you can also reach us by email: [contact email, to be added].
3. Sending an infringement notice
Your notice must be in writing and include:
- your physical or electronic signature, as the copyright owner or someone authorised to act for them;
- the copyrighted work you say is infringed (or a list, if several);
- the material you say infringes and where it is, with enough detail (such as a page address or the board name) for us to find it;
- your name, postal address, phone number and email address;
- a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner.
When we get a complete notice we remove or disable the material promptly and tell the user who posted it, if we can reach them.
4. Sending a counter-notice
If you think material you posted was removed by mistake or misidentification, send a counter-notice with:
- your physical or electronic signature;
- the material that was removed and where it was before removal;
- a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification;
- your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, outside the United States, any judicial district where we may be found), and that you will accept service of process from the person who sent the notice or their agent.
We send the counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action, we may restore the material 10 to 14 business days after we received the counter-notice.
5. Repeat infringers
We end the accounts and access of users who repeatedly infringe copyright, in appropriate circumstances. That can mean losing the account, board entries and online access.
6. False notices
Knowingly saying that material infringes, or that it was removed by mistake, when that is not true can make you liable for damages under 17 U.S.C. 512(f).
