Terms and conditions

Last updated October 29, 2026

Midnight Markdown is an independent game made and run by an individual under the name grailsformail. It is not a company. "We" and "us" in these terms mean that person.

1. Accepting these terms

These terms are an agreement between you and us. They cover this website and the Midnight Markdown game on the web and as a PC app, with its online features (together, "the service"). By using the service or playing the game, you agree to them and to the privacy policy. If you do not agree, do not use the service.

2. What the service is

Midnight Markdown is a free first-person survival game. It has no purchases, subscriptions or in-game payments. Online lobbies, co-op, the public board and cloud saves are optional extras that run on free service tiers.

3. License to play (end user licence)

This section is the end user licence for Midnight Markdown, in the browser and as the PC app. We give you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to install and play the game for your own non-commercial use. We keep every right we do not give you here. You may not:

  • copy, sell, resell, rent, lend, share or redistribute the game, the PC app, its files or your account, or put the game on another website;
  • reverse engineer, decompile, disassemble or modify the game or the PC app, or extract its art, models, music or code for other projects, except where the law allows it even though these terms say no, or where an outside licence on the credits page lets you use that part on its own terms;
  • cheat: use bots, trainers, aimbots, modified clients, edited saves or altered game traffic, or get around the game's checks, limits or protections;
  • remove or change any copyright, licence or credit notice.

The license ends automatically if you break these terms, and we may end it at any time under section 13. When it ends you must stop playing and delete the PC app. The game is provided as is (section 11) and our liability is limited (section 12). In-game items are covered in section 6. The full end user licence agreement is part of these terms.

4. Eligibility

Midnight Markdown is for players 13 and up. This is our own guidance, not an ESRB or PEGI rating. Players under 13 may play offline but may not create an account, post a name to the online board, make a cloud save, or create or join online lobbies. If you are under 18, a parent or guardian should read these terms and the privacy policy with you and agree to them for you.

5. Accounts and security

  • Where the game offers accounts, you pick a username, give an email address and set a password. Usernames must not impersonate anyone or be offensive; we may change or remove one that is.
  • Keep your password and your recovery key secret. The recovery key is shown once; if you lose both it and your password, we may not be able to get your account back.
  • You are responsible for what happens under your account. If you think someone else got in, change your password and use Log out everywhere, and tell us.
  • You can delete your account from the game at any time. Do not sell or share accounts.

6. Your content

"Your content" is what you put into the service: usernames and player names, lobby names, the runs and names you post to the online board, and your saved game data. You keep what is yours in it. You give us permission to store, show and send it as needed to run the game (for example, to show your name and score on the public board and to other players in your lobby). Do not post names that are offensive, impersonate someone, contain personal information or break the law. We may remove any board entry, name or lobby that breaks these terms. Saved game data and in-game items (levels, XP, cases, camos, attachments) have no money value and cannot be sold or exchanged. Cases and Super Cases are earned only by playing (reaching certain rounds and levels). They cannot be bought with real money or anything else, the game has no in-game purchases, and the odds for each rarity are shown in the Cases tab before you open one.

7. Acceptable use and online conduct

When you play online (lobbies, co-op, the public board) or use any other part of the service, do not:

  • cheat: post faked scores, edit saves or game traffic to change results, or use bots, trainers or modified clients online;
  • use exploits or bugs to get an advantage or harm other players, instead of reporting them to us;
  • harass, threaten or abuse other players, or post hateful, sexual or illegal content;
  • attack, overload, scrape or probe the service, its game server or other players, or try to get into accounts or data that are not yours;
  • spam or post scams;
  • record, stream or share other players' names, voices or messages in a way that breaks the law where you or they live, or post recordings of other players to harass or expose them. If you record or stream online play, you are responsible for getting any consent the law requires.

8. Third-party services

The service relies on others: Cloudflare (hosting, network and the game server) and the open fonts, code and art listed on the credits page. Their own terms and policies apply to what they do. We are not responsible for their services, and an outage on their side can stop parts of ours.

9. Our intellectual property and asset licences

The game, its code, models, maps, music, sounds, names and the site's text and design belong to us, except the outside fonts, libraries and CC0 assets, which belong to their owners and are used under the licences on the credits page. The game uses no real shoe brands or logos. To report copyright infringement or send a counter-notice, follow the copyright (DMCA) policy.

We are not affiliated with, endorsed by or sponsored by any shoe brand, store or marketplace.

10. Availability and changes to the service

We do not promise that the game, its online features or saves will always be available. Online lobbies, boards and cloud saves run on free service tiers and may be busy or limited. We may change, pause or stop any part of the service.

11. Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the game is free of bugs, that your saves or board entries will never be lost, or that the PC app will run on your computer.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for lost game progress or data, even if we were told they were possible. Because the service is free, our total liability for any claim about it is limited to zero dollars, or the lowest amount the law allows if it does not allow zero. Some places do not allow these limits, so they may not all apply to you.

13. Suspension, termination and indemnity

We may remove content, reset board entries, close accounts, or suspend or end your access if you break these terms, or if we need to protect the service or other players. You can stop using the service at any time; deleting your account or your local data in the game's Settings ends that part. Sections 6, 9, 11, 12, 13 and 14 keep applying after termination.

To the extent the law allows, you agree to cover us for claims, losses and reasonable costs (including legal fees) that come from your breaking these terms, your content, or your misuse of the service, and to help us defend such a claim if we ask. This does not apply to the extent a claim is caused by us.

14. Governing law and disputes

These terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Before filing any claim, please contact us first so we can try to sort it out. Nothing in these terms takes away consumer rights that the law where you live gives you and that cannot be waived.

Dispute resolution and arbitration: [dispute resolution and arbitration terms, to be added by the operator]

15. Changes to these terms

We may update these terms. We will change the date at the top of this page and, for material changes, show a notice on the site or ask again in the PC app. If you keep using the service after a change, the new terms apply.

16. Contact
